Terms of Service

1. Purpose and Scope

These ToS define the terms of access to and use of the ToubibTrip platform, accessible via the website toubibtrip.com and the iOS and Android mobile applications. ToubibTrip is a technological platform for connecting patients (travelers or residents) with healthcare professionals, enabling practitioner search, online appointment booking, teleconsultation, and secure payment for consultations.

2. Definitions

The following terms, used with a capital letter, have the meaning indicated below:

• "Platform": all ToubibTrip services accessible via the website and mobile applications.
• "User" or "Patient": any individual registered on the Platform to search for a healthcare professional and/or book an appointment.
• "Healthcare Professional" or "Practitioner": any doctor, specialist, or healthcare professional registered on the Platform whose professional identity has been verified.
• "Appointment": any consultation (in-office or teleconsultation) booked via the Platform.
• "Teleconsultation": medical consultation conducted remotely by videoconference via the Platform.
• "Organization": clinic, hospital, or group practice registered on the Platform grouping several Practitioners.
• "Partner": insurance company, mutual insurer, or business that has entered into a B2B contract with ToubibTrip.
• "Services": all functionalities made available on the Platform.

3. Acceptance of ToS

Use of the Platform implies full and complete acceptance of these ToS. When creating your account, you expressly confirm that you have read and accepted these terms. ToubibTrip reserves the right to modify the ToS at any time. Users will be informed of any substantial modification by email or in-app notification at least 15 days before they take effect.

4. Description of Services

ToubibTrip offers the following services:

• Search for healthcare professionals by specialty, location, spoken language, and availability.
• Online appointment booking with immediate confirmation and automatic reminders.
• Secure teleconsultation by videoconference with medical document sharing.
• Secure online payment and billing management.
• Management of family member files (relatives, minor children).
• Multilingual interface allowing you to find a practitioner who speaks your language, anywhere in the world.

5. Registration and User Account

Access to certain services requires creating a user account. By registering, you commit to:

• Provide accurate, complete, and up-to-date information during registration.
• Maintain the confidentiality of your login credentials and not share them with third parties.
• Immediately inform ToubibTrip in case of unauthorized use of your account.
• Create only one account per person. Any account created with false information or for fraudulent purposes may be immediately deleted.

6. User Obligations

By using the Platform, you commit to:

• Use the services fairly and in accordance with their intended purpose.
• Not disrupt the functioning of the Platform or compromise its security.
• Not impersonate a third party or provide false medical information.
• Respect Healthcare Professionals and adopt courteous behavior during consultations.
• Not use the Platform for illegal, fraudulent, or immoral purposes.
• Not extract, collect, or exploit Platform data in an automated manner (scraping, data mining).

7. Appointment Booking

Appointments are subject to Practitioner availability and confirmed by email and notification. Booking must be made at least 2 hours before the appointment time and at most 60 days in advance. The standard duration of a consultation is 30 minutes, configurable by the Practitioner between 15 and 120 minutes. Any confirmed appointment commits the Patient to attend or cancel within the specified timeframes. Repeated no-shows may result in restrictions on your account.

8. Teleconsultation

Teleconsultations are conducted via secure videoconference through the Platform. The Patient must have appropriate equipment (camera, microphone, stable internet connection). Teleconsultation does not substitute for a physical consultation when medically necessary. The Practitioner reserves the right to end a teleconsultation and recommend an in-office consultation if deemed necessary. Teleconsultations are subject to regulations in force in the Practitioner's country.

9. Financial Terms

Consultation fees are freely set by each Practitioner and displayed on the Platform before booking. Payment is made securely online via our payment provider Stripe (PCI-DSS certified). The amount is pre-authorized at the time of booking and charged after the consultation. A detailed invoice is automatically generated and available in your personal space. ToubibTrip charges a fixed service fee on each transaction, transparently included in the displayed price.

10. Cancellation and Refund

The cancellation conditions are as follows:

• Cancellation more than 24 hours before the appointment: full refund (100%) of the amount paid.
• Cancellation between 12 and 24 hours before the appointment: 50% refund of the amount paid.
• Cancellation less than 12 hours before the appointment or no-show: no refund. In case of cancellation by the Practitioner, the Patient is fully refunded. ToubibTrip reserves the right to modify these conditions in exceptional circumstances.

11. Healthcare Professional Obligations

Healthcare Professionals registered on the Platform practice as independent practitioners. They commit to maintaining their qualifications up to date, providing care in accordance with the rules of medical practice and professional ethics. A verification process is implemented by ToubibTrip (verification of diplomas, professional registration number). An unverified doctor can under no circumstances receive appointments via the Platform.

12. Liability

ToubibTrip acts as a technical intermediary and does not intervene in the medical relationship between the Patient and the Practitioner. ToubibTrip cannot be held responsible for: medical acts performed by Practitioners, the quality of care provided, diagnoses or prescriptions issued, damages resulting from temporary service interruption for maintenance, or content published by users. Nevertheless, ToubibTrip commits to ensuring the best possible availability of the Platform and verifying the qualifications of registered Practitioners.

13. Intellectual Property

All elements composing the Platform (texts, images, logos, trademarks, database, software, architecture, design) are the exclusive property of ToubibTrip or its partners and are protected by intellectual property laws. Any reproduction, representation, modification, or exploitation, in whole or in part, without prior written authorization from ToubibTrip is strictly prohibited.

14. Personal Data Protection

ToubibTrip processes your personal data in accordance with GDPR and the French Data Protection Act. The methods of collection, processing, and protection of your data are detailed in our Privacy Policy, accessible from the website footer. By using our services, you acknowledge having read this policy.

15. User Content

Users may be required to post reviews or comments on the Platform. You remain responsible for the content you publish and commit not to publish illegal, defamatory, insulting content, or content infringing on third-party rights. ToubibTrip reserves the right to moderate and delete any content contrary to these ToS.

16. Hyperlinks

The Platform may contain links to third-party sites. ToubibTrip exercises no control over these sites and disclaims any responsibility for their content, privacy policies, or practices.

17. Force Majeure

ToubibTrip cannot be held responsible for non-performance or delay in performing its obligations in case of force majeure, as defined by Article 1218 of the French Civil Code, including in particular: natural disasters, pandemics, wars, strikes, technical infrastructure failures, or government decisions.

18. Termination

You may terminate your account at any time from your personal space settings or by contacting our support. ToubibTrip may suspend or terminate your account in case of violation of these ToS, fraudulent behavior, or abusive use of the Platform, after prior notification. Termination does not affect already confirmed appointments or ongoing financial obligations.

19. Mediation and Dispute Resolution

In case of dispute relating to these ToS, we invite you to contact our customer service at support@toubibtrip.com to attempt to resolve the dispute amicably. In accordance with consumer protection provisions, you may use the free consumer mediation service.

20. Applicable Law and Jurisdiction

These ToS are governed by French law. In case of dispute not resolved through mediation, the competent courts of Paris shall have sole jurisdiction, subject to mandatory consumer protection provisions that may confer jurisdiction to other courts.
